Please review these terms carefully before accessing Tenderpoints™ Hub. Your use of this platform constitutes agreement with all licensing, intellectual property, and anti-scraping rules below.
Summary of Core Principles
Tenderpoints™ Hub is an independent, open-access medical board-preparation initiative engineered for medical students and resident physicians. Access is provided free for individual, personal study. Automated data extraction, programmatic scraping, and unauthorized reproduction or repackaging of questions, notes, audio, or atlas media for commercial test preparation or third-party commercial services are strictly prohibited.
1 Acceptance of Terms & Scope
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Tenderpoints Hub (“we,” “us,” or “our”), governing your access to and use of tenderpoints.org, including its subdomains, APIs, practice question banks, visual atlas, podcast media, diagnostic solvers, and downloadable study guides (collectively, the “Platform”).
By accessing, browsing, interacting with, or downloading content from the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Medical & Legal Disclaimer. If you do not agree to these Terms, you must immediately cease all access and use of the Platform.
2 Personal Educational License & Permitted Use
Subject to your ongoing compliance with these Terms, Tenderpoints Hub grants you a limited, personal, non-exclusive, non-transferable, revocable, non-sublicensable license to access, view, and interact with the Platform materials solely for:
- Individual, personal medical board-examination study and revision (including COMLEX-USA® Level 1, Level 2-CE, Level 3, COMAT®, and USMLE® Steps 1–3).
- Self-assessment via our interactive question banks, score deficit analyzers, and diagnostic algorithms.
- Personal clinical clerkship preparation and non-commercial educational review.
No right, title, or interest in any content, software, graphics, or audio is transferred to you. All rights not expressly granted herein are fully reserved by Tenderpoints Hub.
Strict Prohibition on Scraping, Automated Harvesting & Commercial Redistribution
Strictly Prohibited Activities
Scraping, reproduction, redistribution, repackaging, or rehosting of the question banks, notes, algorithms, visual atlas, and audio materials for commercial test preparation, paid courses, or third-party commercial services is strictly prohibited.
Without prior written authorization from Tenderpoints Hub, you shall not, directly or indirectly:
- Automated Data Mining & Scraping: Use any robot, spider, crawler, scraper, deep-link, page-scrape tool, automated script, algorithm, or programmatic methodology to access, acquire, copy, monitor, or extract any portion of the 8,550+ practice items, clinical vignettes, rationales, answers, images, audio feeds, or datasets.
- Commercial Test-Prep Redistribution: Sell, license, rent, syndicate, bundle, white-label, reformat, or redistribute our question items, diagnostic matrices, clinical summaries, or study guides inside any commercial question bank, course, mobile application, tutoring curriculum, or subscription service.
- AI Training & Model Ingestion: Ingest, scrape, or extract question bank items, answer explanations, clinical scenarios, or visual atlas metadata for the purpose of training, fine-tuning, benchmarking, or evaluating artificial intelligence (AI), machine learning (ML), or large language models (LLMs) intended for commercial or proprietary distribution.
- Bulk Extraction & Mirroring: Download or mirror substantial portions of the question banks, high-resolution visual pathology cases, or audio library to establish competitive repositories or offline distribution channels.
- Circumvention & Rate-Limiting Abuse: Bypass, circumvent, or attempt to disable any access restrictions, security controls, rate limiters, or digital asset protection mechanisms implemented on the Platform.
4 Intellectual Property, Copyrights & Common-Law Trademarks
The Platform and its entire contents—including the original clinical question formulations, distractor rationales, mnemonic frameworks, software source code, interactive web apps, UI design layouts, and compilation structures—are protected by copyright under Title 17 of the United States Code and international copyright treaties.
Trademark Notice: Tenderpoints™ Hub, the Tenderpoints heartbeat pulse logo, and Tenderpoints: ED Shift™ are common-law trademarks asserted under Section 43(a) of the Lanham Act (15 U.S.C. § 1125(a)). You may not use, adopt, imitate, or display these marks in connection with any commercial product, publication, or service without prior express written consent.
All printable guides, algorithmic flowcharts, and generated PDF study aids are marked: © 2026 Tenderpoints Hub — Educational Use Only. Resale or paid redistribution of these guides is strictly forbidden.
5 Audio Podcasts & Media Rules
Audio episodes hosted on or linked through the Platform—including Tenderpoints and Tenderpoints: ED Shift™—are produced for open-access medical trainee education. You may stream these episodes for personal study. You may not re-broadcast, re-encode, rip, monetize, or republish the audio files or accompanying transcripts on external commercial podcasts, YouTube channels, or test-prep platforms without explicit written permission.
6 Third-Party Trademarks & Nominative Fair Use
All third-party examination names, product titles, and institutional marks referenced across the Platform are the exclusive property of their respective trademark holders:
- COMLEX-USA®, COMAT®, COMSAE®, and NBOME® are registered trademarks of the National Board of Osteopathic Medical Examiners, Inc.
- USMLE® is a joint program of the Federation of State Medical Boards (FSMB) and the National Board of Medical Examiners (NBME®).
- ACEP® is a registered trademark of the American College of Emergency Physicians.
References to these third-party examinations and organizations are made strictly under the doctrine of nominative fair use to accurately describe the scope, academic milestones, and testing formats for which our independent educational materials are prepared. Tenderpoints Hub is not endorsed by, sponsored by, or affiliated with the NBOME, NBME, FSMB, ACEP, or any official examination board.
7 Medical Disclaimer & Limitation of Liability
The Platform provides theoretical board-preparation materials and educational simulations only. Nothing on the Platform constitutes professional medical advice, clinical diagnosis, or patient management directives. Bedside clinical decisions, medication dosages, and patient resuscitation must always be governed by licensed physician judgment, primary peer-reviewed literature, and institutional hospital policies.

8 Violations, Access Termination & Legal Remedies
We reserve the right, in our sole discretion and without prior notice, to investigate and take legal action against anyone who violates these Terms. Remedies include, but are not limited to:
- Immediately terminating or revoking your license to use the Platform.
- Blocking offending IP addresses, IP subnets, or API user agents.
- Filing formal notices of copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512 / DMCA) with internet service providers, hosting hosts, and domain registrars.
- Seeking preliminary and permanent injunctive relief, compensatory damages, statutory damages, and legal costs under applicable state and federal laws for willful copyright infringement, trademark infringement, and breach of contract.
9 Modifications, Severability & Inquiries
We may revise these Terms from time to time to reflect evolving features, legal requirements, or security protections. Changes become effective immediately upon posting to the Platform with an updated effective date. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed without affecting the validity and enforceability of the remaining provisions.
